OK I've missed the deadline & that is my mistake - doing my husbands accounts over christmas & spending valuable time with my children took priority.
There is a lot of information out there to read through & try to understand & then tweak to our set of circumstances. I thought I was being helpful by providing all the information that I had. We are receiving letters in one name from one company and letters from a different company in a different name, its not a scenario that I have been able to find on here. Sorry if you feel I have wasted forum space & time in doing this.
So back to POPLA codes, the original POPLA code was in a letter that came addressed to Mr Windows - is it worth asking for another POPLA code under my husbands real name?
Thanks0 -
Chill.
Bombarding you with multiple letters from seemingly multiple companies is Debt Collection 101. It is not a question of won't, these companies cannot sue you or your husband.
The one thing that debt collection companies do not want you to know is that they have absolutely no more powers than you or I when it comes to collecting debts and in respect of many they purport to chase they actually have fewer - because the debt is not theirs, it has not been assigned to them and all they are doing is charging the original company a fee for sending a threatening letter. They cannot issue proceedings in respect of a debt that is not theirs and especially so when it comes to pursuing a PCN.
They therefore have no option but to make a lot of noise, throw lots of dust into the air and attempt to brow-beat you by applying pressure. Remember: the ONLY way that the majority of debt collection companies make real money is if you pay up.
The POPLA issue has passed unless you are able to name the driver at the time and then appeal as the driver - assuming that your husband has not already done so (as opposed to appealing as the keeper). My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
As HO87 says, relax and ignore the letter chain of rubbish. You won't get another POPLA code I am afraid but this is no biggie. It's just letters, we've all ignored them before POPLA existed. As above, the POPLA chance has been and gone unless the keeper is able to name the driver as a different person (i.e. if you were driving he writes & names you then you should get your own PCN to appeal - but some PPCs don't play ball with that. And if he was driving, that's not an option, especially as he's already appealed.
I wasn't meaning to be rude above, I was just trying to avoid us getting more threads full of 'OMG I got another debt collector letter, is this one serious?' updates which is what people tend to do, and we can't cope. And there only so many ways to say IGNORE! Much better for you to simply Google a phrase from each silly letter and read the Google forum results of people who have ignored it for years and years without the sky falling in on them. And nothing will happen to you either.
Your only other option is a major complaint to the retailer or retail park, in writing, assuming it was a park of shops. Google the name of the place to find who runs/owns it and email them about the harassment driving you away from ever returning.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
