I am struggling to way the options if I am honest..
Ignore, goes to court, I end up paying the full £100 + the lease company admin fee £45. Plus any extra costs the VCS state in the letter they can charge me.. not to mention time away from my desk and travel etc..
I stopped in an emergency, the road had no markings just a little sign at the side of the road..no way of knowing where this "restricted road" starts or finishes as the road goes to a McDonalds then apparently just becomes restricted..
Emergency so didn't even see it, but will the Judge just say, tough, its restricted etc..
so really battling wether to pay the discounted rate, but the stubbornness sin me wants to fight them0 -
You can appeal following all the points in the newbie thread and when it is refused, and if it goes court, you can at least then show you tried to be reasonable by following their little charade of an appeals process.
If you follow all the advice on here, you won't be paying a penny, it's up to you, it's your money, but I certainly wouldn't pay a penny to a PPC, unless ordered to do so by a court.
One of the more regulars will be able to tell you how many times VCS have taken to people to court, as I don't know.0 -
I have read a few court transcripts from this company over the past few weeks (over the last year), all of which have been unsuccessful for them (VCS).. but again, these where all for parking charges, not a restricted road, which makes me more edgy as there seems to be nothing to use for this type of issue..

I did read the newbie posts before I started with this thread. But now we have moved on to the next level, I will go back through and see if there is anything that is relevant now I am appealing to the IAS.0 -
You're appeal to the IAS will almost certainly be refused, so I wouldn't waste to much time on it.0

For reference does / has anyone carried this through to court and lost? Just so I can see how much this fee could rocket too if taken to court so I can make an informed decision on my next steps? - long shot I know..0 -
there are many court cases referred to on here, some are in the NEWBIES sticky thread (linked) , possibly linked from the crabman thread too
some are on parking pranksters website
various people including bargepole , coupon-mad , hoohoo and others have indicated what the costs are if you lose, plus in some reported cases it has been a lot more than the usual less than £200
I suppose the BEAVIS case next month may bring about an addition to those details, but will cost PE a fortune if they lose0 -

Seems a very 50/50 depending on Judge and the companies tactics..
Is the not a GPEOL still apply in this case, for stopping on a restricted road for a few minutes? as a carpark you can stop in, a restricted road you can't..
seems my two factors if this goes to court are:
1. not a GPEOL (if this can stand for this type of case)
2. Mitigating medical emergency (but obv no proof for the court)

Hi Ampersand,
I have looked through Parking Prankster's Blog yes, and been in touch with them, a very kind few emails have been exchanged with some great advice and pointers given. They did note they had seen this post and to keep them updated..
It has renewed my confidence to fight this, should it go to court.
I am tempted to contact "Private parking Appeals" and have them draft the letters for the appeal to the IAS on my behalf so I know everything has been done correctly.
I will of course keep the thread updated as I go along..0 -
