Genuine pre estimate of loss rule change? Smart parking

Hi all- received a PCN from smart parking. - appealed in the normal way, using the template-

Received a response today saying they are upholding the charge-

Letter states that "a pre estimate of loss is no longer a requirement by the BPA as of October 2014"

Seems to to me this is the main reason that POPLA reject pcn's.

Is this going to cause a problem ? Their letter says that if I appeal to POPLA I will lose my opportunity to pay the 'discounted'(thanks!) 'offer'

I was expecting them to agree to cancel the PCN, but am worried that POPLA will not cancel it now.

  • The BPA may think this, but POPLA will still rule on no GPEOL. POPLA is independent of BPA, or so it is alleged :-)

    The BPA might no longer require a GPEOL, however, the Law still does and no matter what position the BPA think they hold in the food chain, they are not above the law.

    When you get their evidence pack back, post it here for help with a rebuttal. If you get no pack after 28 days, complain to POPLA
