Virgin Media Cancellation

Hi,

I have had to cancel my Virgin Media due to moving into a property that Virgin do not cover. I am being asked to pay a cancellation fee, even though never received any contract from them through the post.

The attitude from them is that as I never returned my contract, the one I never received, within 7 days they have accepted it as a verbal 'I agree to their terms and conditions'.

Where do I legally stand on this issue.

Thanks for looking.

You entered into a contract when you took the service and are now breaking the contract .

In essence your contract acceptance is binding when you actually pay for it. If money changes hands, then you agree whatever terms apply, and the onus remains with you to ensure you are aware of them. It is your choice to move, so any extra cost for the minimum term or 30 days notice is simply a cost of moving.
