wording for re-setting PCN

Good morning,

Can someone help please........even though we have received LBCCC (ParkingEye), how do I word the "the registered keeper was not driving the vehicle at the time of the alleged offence....." letter? Is there a template somewhere that I've missed?

    The driver was [FULL NAME AND ADDRESS]

    This therefore discharges my responsibilities under the Protection of Freedoms Act 2012, and this letter will be relied upon in the event of your continuing to pursue this matter against me.

  • Thanks for the clarification. I thought I could reset POPLA by doing so - so much advice, lots and lots to read, am floundering a little......shall revert to original plan re. challenging LBCCC through the Practice Direction. Thank you.

    If the driver was a different person to the keeper, and the driver is happy to accept that they were the driver, then nothing bad will come of this. All that's needed (if PE were stupid enough to try court) is a sworn statement from the driver that they were the driver. If you send the "reset the clock" notice (note: don't refer to the term "reset the clock") then PE would be in breach of the BPA CoP, and also POFA, by continuing to pursue the keeper.

    As I recall, Chris Huhne perverted the course of justice in relation to a statutory offence, not a private invoice. ;)
