2 more PE charges bite the dust at this car park, one for my missus and one for her colleague, both at the first appeal.0

Just wanted to say a big thank you to the advice in these threads.
We returned from 2 wks holiday on the 22/12/14 to find 2 Parking charges from parking eye, 1st one for £60 and the 2nd for £100 as the 14 days period had elapsed.
When we checked back we had visited this carpark and spent quite a bit of money in Home Bargains as we were pre buying Christmas presents. We remember the big queues on check out but never gave any thought to us over running in the car park.....which was by 20 mins.
Unfortunately we could not find our receipt from the store and we paid cash so no transactions visible on our bank statement so we had no proof of purchase from the store.
We were unsure what to do, so we checked with family and our daughter has a friend who works in the Police Force and she advised it is only a charge notice and not to pay it as the only people who can enforce parking fines are the Police and the Council.
So we didn't pay.......
The next letter arrived from Parking Eye arrived advising the the 29 days had passed and no payment had been received. They threatened legal action if it was not paid within a further 14 days.
So, back on the web, onto MSE and saw the threads.
Even though the period of appeal had elapsed I though I would try the standard letter on the Newbie thread and even though it exceeds the 3000 characters you can actually send the letter in full (approx 3500 characters) as an attachment and just add the comment in the text box to 'please see the attached letter'.
The appeal went in on the 14/01/15 and I received an e-mail on the 27/01/15 cancelling the charge :T.
I was over the moon to say the least and would strongly recommend that anyone caught by these rogues should use the same letter 'word for word' as it works.
Thank you again.:)0 -
Have any of you fellow bury people had a parking notice from woodfields retail park(tesco)??
If so will the template used above be ok to use there?? I've told them I wasn't driving but nothing else. I've been issued with a popla code so need to appeal.
Any advise would be appreciated
Thanks 0 -
You started your own thread last night - please stick to it rather than bump other threads.

Hi, give it a go, nothing to loose. Only Police and Council can impose a legal fine. As I said in my thread the letter e=worked out over 3000 characters, so add it as a document and just add a comment in the text box referring to attached letter.
RAC also investigating and claim thatchy are illegal.
I actually submitted a counter claim advising I would be charging them £15/hr.
Received a letter from them declining to pay as we had no contract. Works both ways.
Good luck0 -
I just received a parking charge of £100 or £60 if I pay in 14 days! I was going to pay it until I came across this post, so I've sent the template fingers crossed they cancel it! I'll let you know how I get on as it seems to be quite a while since this post was last updated.0

Please start a new thread, and complain like hell to the site owner, tell them - the site owner that is that you may claim any costs that you incurr as a result of their agents ( parking eye's) actionsFrom the Plain Language Commission:

Initial appeal is unlikely to be cancelled, so you're 'fishing' for a POPLA code at this stage. POPLA is the place to kill off PCNs. You won't get any more help on this thread (as it's not your own, plus it's rather 'ancient').
If more help needed, please start a new thread of your own where you can get bespoke advice relative to your specific circumstances. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
