car accident 3rd party denying liability

  • I remember being told many years ago that ACCIDENTS ARE CAUSED, THEY DON'T HAPPEN. It's quite obvious there are many things that lead to my collision, but it wasn't an Act of God and could have been averted if the 3rd party had driven a little slower and not braked whilst coming down the hill. She did not brake to avoid me, she braked to slow down, which caused the skid, which caused her to lose control, which caused her to crash into my vehicle. The location is immaterial. I was actually off the road when she struck me. I can see her insurance company trying every angle to not pay as this is how multi million pound industries make money, buy taking money ,not giving it. I was also told this morning that they wont admit liability due to an injury claim,which I have not yet submitted, but at has been reported I went to hospital.

    Which is maybe why what you call a road "accident" is these days referred to as an "incident"!


    You can be blameless in an incident but still have to pay for your own repairs.


    Which is the good reason to take out comprehensive cover no matter how confident you are you will never do anything to damage your own car.
  • This has now finally been resolved. On the 23rd Dec my repair garage rang me to say they were collecting my courtesy car that day as the cost of repairs were over the value of my car and my insurance company had written my car off. I immediately rang Churchill and after much painstaking waiting and redirecting they also confirmed that the 3rd party insurers LV had finally admitted liability. This entitled me to a proper courtesy car until I am reimbursed for the value of my car. The engineer from Churchills rang me on christmas eve and offered me a value for my car. He took into account the online valuations, the mileage and condition of my car and made me a reasonable offer. I still countered this with what I had recently spent on the car and it's full dealer service history and he upped his offer and extra £250.00. I have a Ford Focus 56 plate with 132k mileage. Unfortunately the mileage goes against me, but I he has offered £2750.00 and to research the value myself. He is ringing me on Monday for my confirmation.

    I don't know what engine size you have, but a quick plug of some figures into Autotrader, shows you should be able to pick a presentable model up for the offer price or thereabouts.
