Returning goods.

Bought a fleece online and its not needed, I know I can return it but do I have to pay postage?

    You have already cost the retailer time and money to send it to you now you want them to pay for you to send it back to them?

    Yes I want them to pay to return the goods if that is my rights, if not I will pay. Ok I will rephrase the question, under DSR'S (or whatever they are called nowdays) does the buyer or the seller pay postage for returned goods?

    The buyer pays the postage for the return of goods, you have now decided you don't want it,


    If it was faulty, it would be a different matter.

    It depends.
    If the retailer complies with the regulations, the Consumer contracts (information, cancellation and additional charges) regulations and informs the consumer that they will have to pay to return the goods then this is what they must do.
    If they fail to provide the information in the correct way then the retailer is liable for the return costs.

    As above, only if the retailer has fulfilled their obligations regarding providing the information as to who must bear the return costs.

    Bear in mind also, under the new CCRs if the product has been unpacked/opened then the seller may also apply a surcharge* to account for loss of value of the goods, IF this was mentioned in the T&Cs that were available prior to conclusion of the contract.

    * The actual terminology in the CCRs may be different, but the effect is the same.

    Do the CCR's forbid you from opening packages? From memory, they only allow deductions to be made from the refund if the customer goes beyond what is reasonable to ascertain the nature of the goods. It wouldn't be possible to ascertain anything about the fleece if it isn't opened.

    That's what I don't like about the new CCRs ... they can be quite vague for some very important aspects. :(
