Help needed please! Reclaiming an old payment from bank

Please can somebody give me advice.

I've gone tbrough some old bank statements and realised that a payment was made 4 years ago by my bank to an organisation that was an overpayment.

I haven't got any supporting paperwork but just know it is an overpayment and I don't agree with it.

Can I claim it back after all this time from my bank?

    I would assume if it's an overpayment you would now be in credit to the company it was paid to? Why? Dont you just contact them and ask for a refund.

  • If you bought a pint of milk a week ago and you had not put it in the fridge would you ask Tesco for a refund because it had soured?

    I think you know the answer.
    You don't say how the overpayment was made but the easiest way is to ask the organisation for the refund.

    How was the payment made?

    Direct Debit, incorrect amount taken by payee - would normally be covered by the DD Guarantee, and I suspect that even after 4 years it still is, so your bank should refund this if requested.

    Standing Order (1) incorrect amount paid out by bank (e.g. processed twice in error) - bank should refund.

    Standing Order (2) incorrect amount set up by you - request refund from payee.

    Online payment - most likely to be an incorrect amount specified by you, request refund from payee; if you have any evidence that the bank made an error and paid more than you asked it to then complain to the bank.
  • The Payment Services Regulations 2009 obliges the banks to refund an 'incorrectly executed' payment made within the last 13 months, I doubt many banks would refund if they are not obliged too.

    Like the previous posters have suggested, I would recommend that you contact the payee.

    You could probably claim it back from the payee :)

    But be quick! You only have 5 years in Scotland or 6 years in England and Wales.

    Of course, with no evidence, if the payee refuses/denies they owe you anything, you will be stuck.
  • I think it would be a bit challenging trying to convince anyone that this was an over payment when there is no supporting evidence to this effect. I suggest you check around again for anything that you could present as an evidence to the claim of an overpayment, otherwise, this would just be taken as an assumed overpayment, word of mouth complain, with no documented evidence....and the bank or organization would not accept this verbal claim...just my thoughts.
