Dear Martin,
Love your show hope you can advise me.
We recently bought a new leather 3 piece suite from a large furniture store in Norwich.
We waited about 3 weeks and on the day it was delivered the delivery drivers found that there was no way they could get it in our front door.
The delivery drivers phone the store telling there what had happened and they went away taking the 3 piece with them.
A couple of days later we returned to the store and we where told that they could redeliver our suite in 2 pieces so they could get it in our home, but this would take about 6 weeks.
They then said that because they offered to do this at there own expense, we could either chose another suite, or they would not give us our money back.
We do not know where we stand with this. Can they do this?
We do not have our suite and they have our money.
I thought that even if you decide that it was not suitable you could return it within so long.
Please could you tell me if they can refuse to give us our money back like this.

I highly doubt that you will get a personal response from Martin, I don't think he posts on these forums. The regulars here are just ordinary people that help when they can.
Now to your problem. When you buy goods in a store you have no statutory right to change your mind. You can only return goods for change of mind if the store has a returns policy. I'm assuming the furniture shop does not allow returns for this reason.
When buying in store you only have a statutory right to return goods if they don't conform to contract. Did you give them the dimensions of your door, or did they give you any assurances the delivery men could do it in order to get you to buy?0 -
SOLUTION
Take a Glaiser about 5 minutes to take your front window out and 15 minutes to put it back
WIN They dont have to refund
WIN You dont have to wait 6 weeks
WIN You dont have to have your new suite butchered in half
WIN You dont have to choose a different suite which is prolly 'smaller' and still probably take 6 weeks to fabricate

Not sure why the delivery folks not suggested it - Id thought a pretty common solution to pretty common problem - maybe they were new at the jobWhen will the "Edit" and "Quote" button get fixed on the mobile web interface?0 -
It does depend on the window size ! I've never lived in any house with a window wider than my door, personally.

No idea what a "glaiser" is but removing a window is hardly a practical solution for everyone.0

Yes, and waiting six weeks seems easier to me, though you won't have the suite in time for Christmas. Lots of companies have a disclaimer on their website about access of furniture Into the house being your responsibility , and I wonder if there was one on the ops receipt?No idea what a "glaiser" is but removing a window is hardly a practical solution for everyone.0 -
If the OP gave them the dimensions of the door, or if the shop in any way said that delivery wouldn't be a problem to encourage the OP to buy, then I would say the OP can reject the goods.
If on the other hand no mention was made of door size then the OP won't be able to reject them and will have to come up with another solution.0
