SmartParking Asda - appeal process

Hi all,
I got a ticket fom Smartparking a my local Asda in Harrogate last saturday which was one of the busiest shopping days before xmas, and the place was heaving, long queues for the cash machine so i just decided to do my shopping as I did NOT exceed 2 hours (maximum stay permitted) and I have my receipt to prove. I have been trying to use their "online appeal" since then but the PCN details are not on their systems yet (conveniently), and they don't accept appeals over the phone (i dont want to phone and give out my details anyway). But I read on another post that someone sent them the appeal template (on the newbies thread ) via email. Does that really work? If so, shall I wait for the NTK first or can i just email the template and state that i've been trying to do it online?

Or simply pop back into the store and demand it cancelled. The GSM (Store Manager) there is a very amiable chap.0

Read the Sticky thread for NEWBIES before you do anything else. This answers your questions above, including telling you not to contact the parking company until you have received a notice to keeper.

The template first appeal from the NEWBIES thread, sent by any medium, works with Smart. As does complaining to Asda. Do both and see we are right!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

One of the Harrogate Parking attendants does appear rather generous at issuing tickets – and not just around Christmas!
The forum templates work very well with Smart; we have recently received this cancellation email from them concerning one of our vehicles:
Dear Mr
Parking Charge Notice Number: TE
Thank you for your recent communication.
I have noted the points you raised and would like to confirm that we are cancelling the Parking Charge Notice.
If I can be of any further assistance please do not hesitate to contact me.

IMO the best way of avoiding these tickets is to shop elsewhere when possible – for instance the Harrogate Morrisons and Sainsburys car parks aren’t infested.0 -
Thank you all for replying. Yes I have heard many complaints about the fpis trigger happy parking attendants at Asda Harrogate. I will wait for the NTK before sending the appeal. In the meantime I'll have a word with the manager, if he offers to cancel will definitely get it in writing..will keep you posted (for now is asda online shopping only lol)0

Christmas is coming and the PPCs are getting fat...
Second ASda/Smart one today, try a complinet to the ASDA store manager along these lines
"Dear ASDA store manager
I recently visited ( or visited on date) your store and spent X amount of time shopping there.
I was surprised to receive a parking charge notice form your agents, smart parking alleging that I owe them £amount.
The amount that your agents are demanding amounts to an unlawful penalty and does nto represent a true genuine pre-estimate of loss.
This charge notice amounts to an unlawful penalty being imposed by your agents, especially as the car park is a free car park, and I /the driver was a customer of the store, i am hereby informing you that you must cancel your agents charge notice with immediate effect.
I would like to remind you that you as principle are responsible for your agents (smart parking ) actions and should you fail to cancel the parking charge notice then I will have no other option than to consider claiming my costs from you (ASDA stores Arnold) for any expenses and additional costs that I may ruin up, this includes my time at a court recognised rate of up to £18 per hour, travel expenses, stationary costs etc that I will incurr as a result of drawing up a POPLA appeal.
I truest that you will take imediate action in result of this, and you will also take action to prevent this situation occurring again by preventing Smart parking from issuing what amounts to unlawful penalty charges on your landFrom the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0
