Harveys- sofa not delivered.

Hi, I purchased a sofa (£1,800 a corner couch and cuddle couch) on the 19th November in-store. This was an express delivery with a 2 week turnaround. After many calls, them not calling me back, a rude shop manager, I was finally told by a customer service manager today that it is still not in the warehouse but will be early next week and they have booked my delivery for next Friday with a view to organizing a courier for an earlier delivery as I am not home Friday. They are openly admitting fault, they are agreeing that they are now 10 days late and that there service has been terrible. They are telling me I need to accept delivery before I can make a formal complaint and ask for compensation. Where do I stand legally with this? What compensation can I ask for? I have called 8 times now and been caused major stress i don't need as I am very unwell and received news last week that I likely have a serious and rare hereditary disease which is incurable and I could have passed it on to my children. I have 3 children aged 4,3 & 1 with no sofa to sit on, and my 74 year old mother in law is having to sit on the floor when im at hospital appointments to care for them. My job is at risk due to cut backs and my sickness record is slipping, I shouldn't even be working right now so I can't take Friday off for the delivery. Any advice will be gratefully received. Thank you.

  • Would it be possible for your mother in law to be there on Friday to accept delivery? This would surely be a simple solution.

    No unfortunately nobody can be here Friday. It's where I stand legally that's concerning me, by accepting delivery before I am allowed to complain does that lower chances of compensation and what compensation can I ask for? It's not even the delay so much that has annoyed me, it's the rude shop manager and the constant lies I have been fed all this time.

    Legally you can only claim for any provable losses, such as extra days off work or extra travel expenses caused by their failure to deliver. Also if the express delivery cost you extra you should also be asking for that back since they breached the contract.

    Until the item is delivered you donlt know the extent of the complaint or any compensation to claim.

    The second section is irrelevant to everybody except you. It will not have a bearing on Harveys ability to deliver the sofa nor on any level of compensation you could request.

  • Does anyone know of the Head Office telephone number? I have seen that there is no number in any of my on-line searches. I too am having trouble with Harveys regarding a promised refund which has not been honoured. Long story but suffice to say that I have had absolutely no joy with the store or any of its employees including Customer Services who are (as I have since read in past forum topics) as useless as it is possible to be!!!
