How will the court know if the buyer damaged the car after it being sold?
If the car was sold with a valid MOT (not that that particularly matters but it will go some way of showing the cars road-worthiness), and in the buyers words "sold as seen", then there is no case.0 -

The likelihood is a decision would be made not to prosecute on public interest grounds.
Technically though as its a strict liability offence, you would be guilty if you sold a vehicle which developed a dangerous fault the day after passing MOT or even one that slipped through MOT. The law makes no mention of the seller having to know about the state of the vehicle.What will your verse be?
