    FORMS OF WORDING TO BE INCLUDED IN FIXED-SUM CREDIT
    STATEMENTS RELATING TO HIRE-PURCHASE OR CONDITIONAL SALE
    AGREEMENTS
    5. The following forms of wording shall be included, as appropriate, in a statement under this
    Part:

    “Termination: Your rights
    You also have the right to end this agreement early in accordance with section 99 of the
    Consumer Credit Act 1974. You will not have to pay all the sums due under the agreement
    but you will not be entitled to retain the goods if you do this. Details were set out in your
    credit agreement. If you wish to terminate the agreement you should contact us for further
    information including any amount payable on termination.”.
    “If you wish we can provide you with separate settlement figures for your [hire purchase]
    [conditional sale] [NOTE 1] agreement and for your insurance finance agreement. Please
    contact us in writing to obtain this.”

    Check your annual statement for the above, if not included you are not liable for the interest for the duration Black Horse failed to adhere to the
    CONSUMER CREDIT

    Laid before Parliament 4th April 2007
    Coming into force in accordance with regulation 1(2) and (3)
    The Secretary of State makes the following Regulations in exercise of the powers conferred by
    sections 22(1B) and (1E), 28A(3)(b) and (6), 77A(2), 78(4A), 86B(8), 86C(6), 86E(2) and (7)(b),
    88(1) and (4), 130A(6), 182(2) and 189(1) of the Consumer Credit Act 1974(a).

    I've been through my statement of account from Feb 2010 from my hire purchase agreement - most of the correct wording you have listed is there. The only missing part is this -
    “If you wish we can provide you with separate settlement figures for your [hire purchase]
    [conditional sale] [NOTE 1] agreement and for your insurance finance agreement. Please
    contact us in writing to obtain this.”
    Would that give me grounds to apply for redress?

    Also noted that my a statement Feb'09 - Feb'10 doesn't have the following text but my statement Feb'10 - Sep '10 does

    - If you have difficulties making payments under your credit agreement please contact us if
    you have not already done so to discuss terms for the rest of the agreement. You may also want to seek advice on what to do from an independent free advice agency such as the
    Citizens Advice Bureau

    Hi,

    I don't suppose anyone knows what period this mistake refers to. I had a PCP deal on a car with black horse between May 09 and May 12 and just wondering if I'm worth trying to claim.

    Friend got a cheque out the blue today, he's still under his PCP plan tho and I don't know if the mistake was made after my agreement ended.
