    ok. so you guys think I'm ready to submit to POPLA ?

    It looks ok, the main appeal points are covered and Coupon-mad has made suggestions which I hope you've incorporated.

    Unfortunately my brain is mush after 'proof reading' so many 3,000 - 5,000 word appeals week-in, week-out for the past couple of years (more often or not putting in more effort than the OPs who've just copied and dumped from a random appeal example, with little or no understanding what they've 'written'), that I don't do it in detail any more - sorry.

    But, if you're content that everything that is written by you reflects your parking event (not someone else's) and there's nothing there that is so obviously 'wrong' to enable the PPC to immediately contradict it and sow doubts in the Assessor's mind, then send it away.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes indeed and it's easy. Just use the 'make an appeal' page, put in the 10 digit number and your details, tick 3 out of 4 'reasons for appeal' boxes (please don't ask!!) then copy & paste your full wording into the submission box. Job done.

    So just had mail back from POPLA stating Civil enforcement ltd's case.
    They have submitted a upheld claim against the argument for Genuine pre estimated loss due to 'consideration under contract'
    Think I could be doomed :(

  • Oh forgot to add
    I went back to the car park 2 weeks ago and another firm now operates the parking fines etc. New signs all over the car park.
    Furthermore in the response to POPLA they never mentioned the point about having the right to levy charges on the Co ops behalf.

    Did you get any pictures of the signs? Or did they include any with their evidence?

    What do they say? I feel sure the wording won't be sufficient to offer a contractual service for parking.
