Denied by bank and onbidsman

Ive been trying to claim back bank charges and have sent of the letters you have on your site including interest i am owed over £10,000 by santander they they got back to me and said they were going to put £300 from the last months charges plus £75 good will i did tell them i didnt want that as im in serious financial trouble cant pay for food, almost £2000 behind on my mortgage, made redundant from my job and am due to have a serious operation on my spine very soon.
they said they where going to put the money into my account anyway even though i refused it and it wouldnt affect my ongoing claim...... they rejected it
i then went to the financial ombudsman sending of your letter again explaining everything in detail and today they let me down and closed the case
i have read up on going to taking this to court and am very willing to do so but the financial side of it scares me as i dont have any money to do this.
on a good note i did just get a job today but am worried this will go against me when i put a claim in.
any advise you can give me would be greatly appreciated.

Take the £300 and £75 - that will buy you food for a couple of months and take one problem off your mind for a while.
What grounds for refusal did the ombudsman give ?

MSE article makes it clear:It's been more difficult since a November 2009 .... payouts could still be possible... There's no guarantee of winning...0 -
As unpleasant as it may be to hear this, the bank are not required to refund charges and the FOS do not often rule for them to be refunded, since the court case in 2009 slammed the door shut for reclaiming them as "unfair". You aren't "owed" them back in any sense. Going to court will not help you and will just cost you more money that you don't have, as there is no legal basis for them to be refunded.
I would strongly suggest speaking to StepChange about a DMP or the like regarding your debts as this will help you start afresh.urs sinserly,

How do you work out that Santander owe you over £10,000? That's just complete nonsense isn't it? And clearly the OMBUDSMAN agrees.0
