How long to wait for postal NTK

A parking ticket was placed on my car on 21/11/14. I plan to appeal but as I have recently moved house the NTK may have gone to my old address. My mail is being redirected but this is not 100% reliable. I have since the 21/11/14 updated my car details with the DVLA so depending when Euro Car Parks requests the information the NTK should be sent to my new address.

My question is how long do these parking companies, Euro Car Parks in my case, wait before contacting the DVLA for the car owner information? The ticket suggests they contact the DVLA if the PCN is not paid. The PCN is requesting payment by tomorrow (12/12/14) although I have 28 days to appeal which will be a week tomorrow (19/12/14). Should I go ahead and appeal or wait for the NTK which may or may not arrive.

    In your case, see section 8 here. http://www.legislation.gov.uk/ukpga/2012/9/schedule/4/enacted
    For ANPR cases, it's section 9

    Also, you will need to read the Newbies thread at the top of the forum.
  • Thanks for your reply. I have read the Newbies thread which said don't appeal until you have received the NTK. However I haven't received the NTK which is why I'm asking for specific answers to my question. I'm sorry if I sound like an idiot but I'm not great at putting the legislation into laymans terms so it would be great if someone could help translate what the legislation means in relation to me.

    The reason you haven't received the NtK is because the PPC is following POFA,

    Let me home in on the relevant part of section 8

    (4)The notice must be given by—

    (a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or

    (b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.

    (5)The relevant period for the purposes of sub-paragraph (4) is the period of 28 days following the period of 28 days beginning with the day after that on which the notice to driver was given.

    (6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.


    Now please, please don't come back and say you can't understand it now.

    That's great thanks. I had assumed that the NTK would be sent a lot quicker. Guess I didn't want to fall into the 'Do Not Ignore It' trap.
