paid for tesco bathroom with credit card

I paid £9700 on my credit card for tesco and mark 2 bathroom. Items were delivered and are now languishing in my dining room. I have a shower and working loo only. The bathroom is so cold (no heating/plaster on walls/tiles, lights, extractor fan or sink). The wind whistles through the brickwork.
I am going to claim under S75 (already sent a claim form), credit card company are going to phone me today. What do I say to them. I really want ALL my money back. Am I entitled to say so? What are my legal rights? I have read about anticipatory breach. Can I ask for all my money back?
I am claiming for lack of service (bathroom not completed), lack of lifetime guarantee and what else. I have the goods but not fitted.
Tesco have said that they will pay for my new builder to install the bathroom but will pay him AFTER the work has been completed. My builder refuses to do this.
What do I do? My house is so cold, depressing and nowhere to sit for Christmas dinner.

  • Yes, it was a total service which included a lifetime guarantee (where has that disappeared to?) The orginial builder has been advised not to complete the work unless he is paid upfront. He has now received a bill for the items that are in my dining room! I have to pay for the Hipp bag which is on my drive (£109.99) which apparently I will be refunded, but the point is I have paid Mark Two. Tesco are asking for all work to be completed, bills to be sent to Tesco but builders will not do that.
    I am going to ask for all my money back. I don't know if I am entitled to do so.

    Thanks for your reply, much appreciated. I am sure there are customers in a far worse position than myself.

    You are a customer and have paid Mark Two a deposit for work that has not yet started, please contact us on the number below to arrange for a full refund from Tesco.
    You are a customer and Mark Two has commenced work but the fitters have walked off-site, please contact us on the number below and we will do our utmost to provide a solution to ensure that your kitchen or bathroom installation is completed.
    You are a customer and have a warranty issue or any other query, please contact us on the number below.
    You are a fitter currently engaged on a project for Tesco Kitchens or Tesco Bathrooms which you wish to complete and are concerned about not being paid by Mark Two, please contact us to discuss your options.
    When you contact us please have all relevant documentation to hand. You can contact us on our dedicated helpline on 0800 028 2363.
    Any other supplier, or employees, of Mark Two, should make their enquiries directly to them.

    You really need to be contacting Tesco to provide a solution to this, not your credit card provider.

    There is a Helpline number set up by Tesco for precisely this problem, I suggest you ring 0800 028 2363 and forget all about Section 75.
