City Council PCN - Need help!

Hi all,

I need help regarding a PCN issued by Nottingham City Council. I was visiting my girlfriend on a Friday and Saturday and I had to park on a single yellow line as all the visitors parking spaces were taken. I tried to appeal on this grounds but the PCN was upheld so I decided to make the payment at a reduced rate of 35 GBP. Soon after, I received a letter from Nottingham City Council so I ignored it as I have already paid the fine.

However, recently, I received another letter saying that they have increased my fine by 50% to 105GBP. Upon closer inspection, the letter was in relation to a PCN issued on the Friday whereas the PCN i have paid was issued on a Saturday. However, there was only one parking ticket on my windscreen which was the one I paid. I suppose it was my fault that I did not read the letter that was sent to me in the first place but I presume this was an easy mistake to make?

Would I be able to argue that I would have paid the fine as soon as I was aware of it (as I did with the other PCN) at a reduced rate or should I cut my losses and just pay the 105 GBP to prevent going to court.

Sorry for the long post and thanks in advance for any advice.

    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need photos/scans of all correspondence you've received from the council (both sides, if appropriate).

    PePiPoo has an excellent success record in dealing with council tickets.

    Whoops - that was the NTO and that was the Friday one you had to appeal. Never ignore such a letter as you now have a Charge Certificate which you cannot appeal against. Pepipoo posters will possibly tell you to wait for the next letter (OFR) and then write and say no PCN was ever served for that day and the car was not moved between the 2 PCNs, one of which for the following day, was paid anyway. So you feel you should be able to appeal the first one under the circumstances as you were unaware of it.

    Thanks for the reply. I haven't had many responses on Pepipoo. I did some research on the OFR and it says that I will need to fill in a Witness Statement/Statutory Declaration. I had a look at the form and one of the options is I did not receive the Notice to Owner / Penalty Charge Notice. While I did not receive the PCN, I did receive the NTO but I ignored it because I thought it was in relation to the other PCN. Would this option still be applicable or am I better off paying off the fine?

    Yes it will be your option at OFR stage, to say no PCN served. Pepipoo will get back to you in the coming days as long as you have shown them PICTURES of all sides of all documents! And if you have further questions by the weekend, reply on the pepipoo thread to ask.

    Why would you pay £105 in a million years, when you can pay nothing, or once you get it reset to appeal, it would only be £70 even at adjudication if you lose?
