Hi all, I have read the stickys and they have given me some info but im not sure what to do from here on in....
We received a PCN from PCM while attending my sons nativity.We live on the estate in question but we don’t need a permit as we have adrive. The school had told us that all parking restrictions had been lifted somy brother in law (who is from the US) parked my car (he wanted to drive in the UK as hadn't done it before, (and yes he was insured through his insurance) ) downthe road and we went in to the school.
When we came out we saw the ticket, went back to the schoolwho then told us that not all the roads were covered by this lifting of the restrictionsand there is nothing they can do.
As my brother in law is a US citizen, and is going back tothe US next week, I don’t believe we should pay this as he was the driver. I'm notsure what to do as we are going to the US with him for a holiday next week….Anyadvice you can offer would be appreciated. do I contact them, do I ignore....?

Nobody should pay a PCN from a PPC.
Wait for the NTK then appeal, naming your brother as the driver, and give the PPC his permanent USA address.

Perfectly legit (especially where true) to provide a name and address for service for the driver anywhere in the world. The PPC won't agree, but PoFA 2012 implicitly does!
You could, after naming your bro-in-law as the driver (with his US address), get him to write to the PPC from the US, admitting to being the driver, with a final 'go swivel, out of jurisdiction' paragraph.
Could be a bit of fun.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
