letter of offer? can i still go on with the court online?

they have sent me a letter offering me the full amount without interest and without the court fee. can i still carry on claiming through court as i have always asked for the amount plus interest and a bit miffed that if i accept i wouldnt get my £120 back.
what do i do carry on untill the 28 days is up then what??? they have filed a defence and accnowledgement. what do i do will it still go ahead even after todays announcement.?
please help someone?!!???:eek:

    As has been stated on other threads contrary to the impresion given in media reports the decision to commence this court case does not stop other claims. However you can expect an application for your case to be stayed pending the result of the Test Case,
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    personnally i'd accept it as i went the court route after recieving the same offer as you ie. no interest/ court fee and i was just about to get a date and they annouced this, i wish i'd taken the offer, as now i've lost my charges and fee!
  • BUT if the bank applies for a stay YOU can apply to remove the set aside and it will be up to the individual court to say otherwise as it stands. The law of contract has not changed in the last couple of days merely the faith that we all have in the FSA and OFT that has gone down. And the claim is earning s69 8% interest for everyday, month and year that it is stayed for. NICE!

    This is wrong as has been pointed out if you have issued court proceedings these will still carry on and it is for the bank to try and stay the proceedings pending the outcome of the test case.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    id accept the offer. legally, they dont have to pay you interest.
  • I would not accept an offer that does not include the court fee otherwise it is full charges minus £120 for filing. This is your claim and the small claims court has not put a blanket stay on the courts. THe banks can still charge and also, while the test case is on going you are earning s.69 8% interest every day it is not settled. Your claim and Your choice.
