Fenwicks sold me an old product which doesnt work

    You are entitled to claim damages from the trader to cover your losses if they were caused as a direct result of the goods being faulty. This is called consequential loss. For example, if your washing machine developed a fault and clothing was torn, you could claim for the cost of the clothing as well as the repair, replacement, full or partial refund from the trader.




    But what have they damaged of yours apart from pride

    For goodness sake what on earth has pride got to do with it? If i have to take a refund i will have to take one, this is more about the hole i cant now fill in my kitchen.This site is about money saving isn't it?
    Thankyou for all your comments but let's forget Fenwicks for a moment . To answer a previous post, I didn't open the package when I got it home because I didn't have one at that point and yes I know it was probs foolish not too test it but it was delivered to our business address and thought it better to leave it wrapped until we moved in ( don't want to give the whole story ( sorry for the dreadful pun) but it should have been 2 weeks later but ended up being 2 months) and Fenwicks and Samsung are reliable names so we didn't ever suspect we would encounter this - yes I know it's Naive.
    What's niggling me is this : the product is under guarantee for 2 years so what if I had it and it was fine, I put it in my purposely built whole in my kitchen and then the compressor went or something else that they could not repair, how would I be on then? Given that Samsung does not make the product anymore, what would I do?. You see I could go on line now and fill the hole with the same product from John Lewis. It would cost me £150 more but at least my kitchen would look right, however I don't want it to break down 3 months from now as it just has and have the same debacle again. I put this to the nice lady from Fenwicks today and she said if it was under guarantee and it failed and they couldn't fix it, then it would be up to the retailer to sort which doesn't sound right to me. I acknowledge that Fenwicks are only legally bound to repair or refund but what about the manufacturer. Sorry I have gone on a bit about this but any advice on the further points I've mentioned would be much appreciated :)

    Because you have no contract with the manufacturer.
