Help & Advice concerning two PCNs from ParkingEye

Eighteen months ago (May2013) my wife & I wanted to take a large suitcase of second hand clothing to a local charity shop. As the suitcase was large and heavy we wanted to drive as near as possible to the shop. We therefore drove onto a permit only private car park. I did not occupy a parking slot but remained in the common area, making sure I was not blocking anyone or anything, and in fact I moved the car once to ensure this. I stayed in the car, my wife took the suitcase to the shop & we drove away. We were in the car park for fifteen mins. One week later I received a demand from ParkingEye for £85.00. We wrote a letter to them explaining the circumstances and included evidence provided by the charity shop. we received a reply not accepting our justification or evidence. We did not reply to this letter or to further correspondence we received in June and October 2013. On Tuesday 9 December 2014 we received a 'Letter Before County Court Claim'. This letter states that the charge is being levied for breach of contract and unless payment of £85.00 is received within fourteen days then court proceedings are likely to follow.


The second PCN I received in September of this year (2014). This same car park is divided into two zones. One half is permit only and the other is a free car park. This free car park had a limit of two hours and I had used it for many years. There were signs up indicating the two hour limit. At some point during the summer the conditions were changed and the limit was reduced to one & a half hours. I was not aware that this change had taken place as there was no obvious or significant additional signeage indicating this change. In September I parked the car there and returned one hour & forty four minutes later. One week later I received a demand from Highview Parking for £85.00 for an overstay of fourteen mins. We have received similar correspondence as from ParkingEye, but this time includes a letter from Debt Recovery Plus Ltd. We have not replied to any of this correspondence. Any help or advice concerning either of these instances would be appreciated

    Start with the Sticky thread for NEWBIES. The court letter from parking lie is your priority so look for the section in the NEWBIES thread on how to defend this. Do not hang about.

    Your second priority is the one from highview.

    You can safely ignore anything from a debt collector but never ignore anything else from a PPC.

    On Tuesday 9 December 2014 we received a 'Letter Before County Court Claim'.
    For that one, you need to read 'LBCCC Fightback' which is a thread by zzzlazyDaisy which is collated with other stickies near the top of the forum, in a thread by Crabman.

    The best thing is for the keeper to name the other person as the driver. So then - happy days - the driver gets sent their own PCN and will appeal and will win in the end at POPLA as we always do. That idea is actually covered in the Newbies thread in the section on effectively 'rewinding the clock' to appeal stage.

    Much better than facing PE in court. so think HARD then think HARDER about who was driving...it wasn't the keeper was it. Nope.

    they dont use cctv for this , they use anpr

    check the parking pranksters blog some months ago for how anpr is used

    I dont see anything mentioned here about cctv or cctv evidence and its never an issue for parking problems
