Need help! Received parking charge notice to keeper

Hello, I'm a newbie here. Got a "parking charge notice to keeper" from NCP today. The incident was a failure to pay at LUL N Greenwich car park in Oct.
The driver did go into the car park however the driver couldn't find any space there because there were some workers who were putting up new trees. Although there were more than 10 spaces empty, they didn't allow people to park. 10 minuets later, the driver got fed up and went to the next car park which has a gate at the entrance/exit. (Of cause the driver paid before the driver left the second car park)
I'm very confused about why they sent out this PCN over a month? DOES the driver have to pay even they couldn't find a space? Could anyone give me any advice about appeal please?

In addition to the standard advice, an appeal when the NtK arrives saying that the driver did not park as there was restricted availability due to 10 bays being removed for tree surgery. The driver waited for a space to become available, never leaving the car, and, therefore did not park as such, merely waited in vain for a space before driving off.
Courts have already accepted that waiting for a space is not parking and you therefore demand that the ticket be cancelled or issue a POPLA code (assuming NCP are still BPA members).0 -
You appeal using the template in the NEWBIES thread using all the reasons quoted. What happened on the day or why a PCN has been sent out is irrelevant so just stick to the tried and tested appeals process, adding in the point that Guys Dad has mentioned.

Although the letter is issued by NCP, the operator declined that the letter is issued by them.
I wonder does it the Greenwich council or the tube station sent out the letter??:(:(:(0 -

Sorry disturbed you Coupon-mad, I would like to show the letter. Should I post on this thread or PM to you? Without any windscreen ticket, I need to appeal as a keeper within 14 days after I received the first letter. Is that right?0

Please tell me if this is PCN or NtK?
Without windscreen ticket and the letter was sent out at day 37 (received on day 43), do I appeal as the keeper on day 21 after their posting date?
I searched couple of the web sites and neither of them mention to pay if the driver couldn't find a space and leave immediately.0 -
