Parking Company Appeal vs POPLA Appeal

Newbie here, I must say this is a very useful forum with some great contributors.

I am in the unfortunate position of having a parking charge notice from a private parking company.

I am going to appeal to the parking company, and if this fails (which I'm sure it will), go to POPLA.

My question is should I hold the real ammunition I.e. GPEoL, proof of contractual arrangement with landowner, for the POPLA appeal?

Just thinking of keeping my powder dry really, and not giving any pre-warning to parking company of what I'm going to go to POPLA with.

Or will POPLA dismiss my appeal if I raise new, but valid points if I do not raise them in the initial appeal to the parking company?

Would welcome any thoughts on the above please.
Thanks
G.

Just send the first appeal from the NEWBIES thread as-is. Whether you send the same or different appeal points to the PPC and POPLA matters not one jot.

Which PPC is this? (If they're not a BPA member then it won't be POPLA).
  • No need to "keep your powder dry", also if the PPC is Parking Eye they now seem to be upholding challenges with decent forum based help I'm guessing to save themselves the cost of a loss at POPLA

Yes, there is for now a slightly different approach depending upon the PPC involved. So best let us know who it is - you will also get advice on whether or not they have a history of doing court, which is the only place that can really cost you money in the long run.
  • Thanks for the feedback.

It is UKPC and the offence is failing to display permit, in a space in apartment development, for which ownership of the space is transferred to me when I purchased the leasehold for the apartment.

I am the landowner, I haven't suffered a loss! The cheek of it!

I will use the template suggested, that was always my plan, but wasn't sure whether to hold back on GPEoL. I am sure they will concoct a set of losses to try and justify the charge.

    Thanks
    G.
  • Sorry, one other thing, should I ask for the POPLA reference or will that automatically be provided in their response?

The best advice on here is to follow the newbies thread. However, if I was you, my appeal to the PPC would be exactly what you have written in post 5.

After discussion the landowner, we have decide that they have not suffered any loss and are happy for the matter to be settled. If you have any questions or queries regarding this then please contact the landowner. Oh yeah, the landowner happens to be me, so do one!

No. That's why I don't 'ask for POPLA' in the template appeal letter (you don't have to).

But if you've only had a windscreen ticket you won't be appealing until 2015 anyway, as per the advice in the Newbies thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Have had the windscreen ticket, have waited for NTK as per newbie thread. NTK has now arrived so getting ready to respond.

Will update on here when I hear how things are going.

Thanks again to everyone in this thread and those who contribute to the wider parking ticket forum.

Oh good, hadn't realised you were at NTK stage. Nearly won it then!

Just an update on this, UKPC have responded to my letter apologising for any inconvenience they have caused me and have cancelled the PCN.

GPEoL appears to be a sure fire winner, now without the need to go to POPLA.

Thanks for the advice and assistance provided.
