Witness for TR1 and Mortgage Deed

Does it have to be a professional person ie doctor, policeman etc? The Estate agents have advised it can be my next door neighbour?

    It can be anyone not involved in your transaction. My neighbour did ours no problem.

    As far as I'm aware, it needs to be a solicitor. Best to call Land registry who are very helpful.

    Look at section 4.12 Execution. Independent person who knows you. Doesn't have to be a professional.

    I am sure, if i am not mistaken, there is a land registry rep on here. They will know the answer. try searching for them.

    Anybody can witness as long as they aren't connected to the transaction or a family member. They have to know you, obviously.

    OP - your solicitors should have given you instructions regarding witnesses but if you want clarification, ask them, not the estate agent.

    Receptionist at the solicitors signed mine, I seem to recall.... they only knew me from being in there for an appointment.

    I contacted our solicitor but not been able to get hold of them as unfortunately their correspondence just said it needed to be witnessed but thank you for all the responses.
  • We are arranging our mortgage through First Direct, and we've just had to get the mortgage deed re-signed as it needs to be witnessed by a solicitor or a HSBC official. The conveyancer didn't stipulate this at the time, so we're having to get another one sent out.

    Generally speaking anyone can witness. A few lenders want their mortgage deed witnessed by the solicitor, but in that case you would have been invited to come in to sign.

    I've been Money Tipped!
    Our TR1 was witnessed by a neighbour.

    Only glitch was that the neighbour put just an initial for the middle name and LR insisted on us obtaining the full name. Solicitor said she had never come across it happening before!
    It is a good idea to be alone in a garden at dawn or dark so that all its shy presences may haunt you and possess you in a reverie of suspended thought.
