Unless you are in current financial hardship, your chances of "reclaiming" anything at all are nil.

Thank you! I got the £10 back, I sent pictures of the envelope as it arrived (torn on every side and to the extent it was pretty much open one side!).
  • I didn't get to post my complaint until after the last post on Tues (09/12), received a text on Thurs (11/12) from Natwest acknowledging my complaint and apologising that I was unhappy with the service I had received.

It states they may try to contact me during investigation from a blocked/witheld number and provides an 0800 number to call them back on should I miss that call. Also provided a reference number for my case and states that they will write to me within 3 weeks should they not provide a resolution.

I'm sure people are aware of this process now but it's not happened to me before, I was surprised by the speed and efficiency of this. I happened to phone and coincidentally ended up speaking to my case manager who was very polite and friendly - even told me how many cases back mine was and gave me a time frame of 2 weeks to expect an outcome and to call then if I hear nothing.

    I'll update as and when.
  • Keep with it.

Be prepared to go through Moneyclaim online (issue Court Documents) Majority of Banks will make an offer rather than pay to go through Court Process.

If you issue Court Documents you need to prepare well and willing to go all the way.
    HSBC PPI Claimed - £ 2800 -WIN
Halifax PPI Claimed- ( not upheld by them, issued Court Docs-Settled in full) £4560 - WINBarclays Account Charges- Courts documents issued, Barclays offer me £2000, refuse as I want £5000. Barclays settle day before Court- WIN
BlackHorse - Court Documents to be issued Tuesday 06 Jan
  • Just spoke to them on the phone.

My case manager referred to the Supreme Court case (2009), stating that the court ruled fees were not unfair etc and that this issue was whether they had been applied correctly in line with the terms of the account.

They've offered me a goodwill payment of £162 and confirmed I'll recieve the outcome in writing. I didn't try to argue the point over the phone or further make my case (maybe I should?) but I thought best to have it all done in writing etc.

Next stop the FOS I guess!

Wouldn't be too optimistic over the FOS referral as they can't do anything formally because the supreme court case ruled the charges were legal back in 2009 - all they can do is ask the bank to look at it again and the bank will most likely reiterate the court case ruled charges were legal

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
