Pothole damage claim advice
Hi all,
Damaged my car on a pothole last year and have had lots of difficulty claiming for it despite the manhole cover I did it on being 5 inches below the road level.
Sent claim to cheltenham council who said it was a sub-contractors resposibility 'kier', who promptly said it was a smaller subcontractor.
This subcontractor doesn't reply to calls or written messages.
Damage costs were £650 (suspension, wheel and wishbone)
Any suggestions as to what I can do now?

I would continue to claim against the council. It is their responsibility to maintain the roads and to ensure that any work carried out is done to a satisfactory standard. Referring you to contractors, is in my opinion, merely an attempt to avoid liability. Consider county court claim (small claims) if the council refuse to accept any liability. Look into/take advice on joint and several liability.
If you persist you are likely to receive compensation without having to go to court.0 -
I hit a pothole in Kent about 6 weeks ago. Have just received a letter from them saying that they are not responsible as the road was checked 2 weeks before and there was no defect. Any advice?0
