Hello all,

I have an update regarding the PvG scheme, and my application to University to study Nursing, I received an e mail from disclosure Scotland regarding the PvG scheme, this is what I have been told.

Good afternoon,

Weeding is applied to the Scottish Criminal History System, and PVG certificates are populated by information from this system. This means that if a conviction is weeded by the 40/20 or 70/30 rule, it will not appear on a PVG Scheme Record.

Providing your offence is not exempted from the 40/20 rule, we can expect that it will be weeded in 2016 if you are 40 years or older at this time, and that it will no longer appear on a PVG Scheme Record, or any higher level certificate.

You do not have to disclose convictions that have been weeded.

To find out at any given time what information the police hold regarding your historic convictions, you can make a Subject Access Request with the police under Freedom of Information. This costs £10, and you can find more information on the Police Scotland website.

The Criminal History System in Scotland has a weeding policy which states that when a person is aged 40 years old and the conviction is 20 years old simultaneously, then the conviction shall weed automatically from the system unless the conviction is one of the exempted categories.
The following convictions are exempted categories:-

a conviction on indictment
a conviction for any act implying indecency
a conviction or ruling disposed of under the Mental Health Acts
a conviction where a custodial sentence is imposed, including Borstal Training, Detention and Training Order, Young Offenders Institution, etc.

A conviction in any of the excepted categories will be retained until the subject has attained 70 years of age and the conviction is 30 years old plus any period of disqualification.

I am in none of these categories luckily, and the University in question is happy to accept my application for next years intake on the Nursing course, I also have been offered a job as a Care Assistant, and i am just awaiting the PvG check to come through, I will keep you posted in what happens :j
