Used car - gearbox needs replacing after less than 6 months

At the time the car was sold the dealership assured us it was 100% perfect, it was also low miles (around 40k).
I do actually believe the dealer said this, as unlikely as it may be - car dealers do tend to have their own interpretation of mathematics.
If you had asked him to put in writing that
a) The car is 100% perfect
and
b) He personally guarantees the mileage is accurate at 40k
what do you think he would have done?0
