  • Thanks for everyone's replies - particularly Jimmy, yours put it more into context for me!

    I'm leaning towards just paying the policy, particularly because we want to move as soon as possible and will be saving £800 in stamp duty with the new rules (hooray!)

    It's just annoying because our buyer is a buy to let investor and I'm pretty sure he's not getting a mortgage.

    I'll contact the developer first though, because if they're about to get the road adopted that might just satisfy the buyer's solicitor.
  • Just thought I'd post an update in case it helps others...

    A lovely friend who's in planning law looked over our Land Reg title and she said it's defective as it should have contained a clause to provide assurance that the road would be maintained by the developer until adoption by the council.

    When we purchased the house, our solicitor should have noticed this and got the title amended before we signed everything.

    We're using the same solicitor now, so she helped me put this to them in writing asking them to pay for the policy as it was their mistake that is causing the policy to be needed now.

    They agreed to pay!!! So saves us an extra bill and I'm very relieved!

    Good luck to anyone else with this issue, it's difficult when you don't have the expertise to argue against something that doesn't feel right.
