About to start claims...

Hi all,

So I posted this into the PPI thread by mistake (I shall go and delete shortly)

Any help is greatly appreciated.

I have a few old credit cards, catalogues and a bank account that I am going to look into the charges and or PPI issues.

My issue is that 3 of the 4 credit cards are old accounts (not used in last 3yrs) and are closed. I don't seem to have any old correspondance (Still looking around the house for some) but can I write to them and request account details if I don't have no account numbers, card numbers or letters. I can obviously prove who I am.

I'm looking to start the claims on a basis of the fact that they put me into further debt with their charges and I am still struggling to pay them off, thus me being in financial hardship at this present time.

Do you think this will be possible?

    If you are fishing for info then that will cost you £10 each for a data subject access request. However, yes what you want is possible.

    If they are closed then how are you struggling to pay them off?

    You won't be able to retrieve any charges from (fully) closed accounts.

    You'll only be able to (possibly) receive a refund of charges at all if you can show you are in current financial hardship.

    I'm also not sure how you can say thou are struggling to pay off debts on cards that are no longer used and accounts which are "closed".

    Do you actually still owe money on these cards? Have they defaulted and gone to a collection agency?

    No - so don't go wasting what little money you may have on SARs if you are genuinely in financial hardship

    Credit card claims seem to be a dead duck now. (effectively timed out I believe)

    You might have a possibility with reclaiming bank charges if account is open and being used as your main bank account and you are currently incurring default charges and you are genuinely in financial hardship

    Refer to the MSE article

    There is no obligation on a bank to refund charges even if you meet all the criteria.
