Need help enforcing CCJ agains Chertsey Commercials

Hi, I'm new to this forum, but I need some advice regarding a debt that I am owed.
I have a CCJ against Nathan Fletcher trading as Chertsey Commercials after being mis-sold a generator that I needed to start a new business.
One year later, I still have had no joy in recovering one penny of the £8842.02 that he owes me.
I instructed the sheriffs office to attend, but they seem next to useless, I have been doing some digging and found out that his wife owns their house, so I can't go down that road, I have details of his bank account, but it is joint with his wife, so I believe that I can't go down that one either :/
I feel like I am banging my head against a brick wall,
anyone got any ideas?? They will be greatly appreciated,

  • Can't you have him arrested for disobeying court orders? Isn't that classed as an act against the crown? I'm probably completely wrong.

    You are therefore presumably in Scotland? Are you both in Scotland?

    In England you could try a High Court Enforcement Order who have more powers than bailiffs acting under a County Court Order but ultimately if they guy has no assets then you are throwing good money after bad. No idea what the higher level of enforcement is in Scotland.

  • Thanks people, no, not in scotland, have already tried High Court enforcement (The Sheriffs) and gotten nowhere :/
    Guy is self employed so can't get an attachment of earnings order….
    Not sure if he can be arrested as its a civil case, drives me nuts, if I stole a car from him I'd be arrested for theft, yet he can rob me of nearly 9 grand and just not pay it as he obviously knows 'the system' :(

    get an order to obtain information. That forces him to go to court and answer your questions about his bank account and assets. Then you could go for a 3rd party debt order to freeze and claim the money in his bank accounts. Just because its a joint account I dont think it completely stops that if the court thinks enough of the money in the account is his.

  • That sounds sensible, then I guess he has to at least show his face. I don't want to keep throwing good money after bad, so want to plan the next move carefully. I am definitely not prepared just to let him get away with it

    Yes he has to go to court to answer questions. Failure to do that is contempt of court and he could technically be arrested and jailed for that. If nothing else it might give him a fright. ;)

  • I used the infamous Sheriffs from the TV. They were absolutely no use what so ever!

    I did tweet at them yesterday, and that got a response (it is amazing what social media can do for you when you use it to get a response from a Company)

    It's just a shame that Chertsey Commercials don't have a twitter or Facebook!

    Anyway, will keep you posted, am trying to gain more ground today…
