Accused of Flytipping - Advice Needed
Comments
-
The council are fishing for evidence. If they had any they'd be prosecuting. I would not go and would respond as suggested earlier that she has not committed any offence and as she has no useful information to impart, will not be attending.0

I agree. This came up on here before a few years ago. They will try and trip her up and catch her out. She has not been arrested so why go? If they just want to question her then why not visit or write?0

The thread is called wrongly accused of Flytipping and was back in 2013.
Post 84 describes what happened at the interview and that is enough to explain just why OP's sister and dad should not go.0 -

Not to sound smug...
Well frankly, you should not sound 'smug' anyway, because you have no reason to be 'smug.' Nothing in that post number 84 on that thread says or implies that a person called for interview with the council for supposedly flytipping, should not go.
The poster in post 84 said people need to be careful, and went on to say:I'm glad I came prepared, was honest and thoughtful but frankly, if an innocent person like me wasn't confident and prepared, they should DEFINITELY go in with a lawyer.
It would be foolhardy to not attend the interview, as most of the people on this thread have quite rightly stated.
The fact that the two people prior to your post above me here agreed with you, does not make you - or them - correct.
The OP's sister MUST go and she MUST take a solicitor with her.You didn't, did you? :rotfl::rotfl:0 -
Good to see Guest101 was giving the same shoddy, erroneous advice in that thread too.
I was going to elaborate but the fella above has pretty much covered it!0 -
Yes unfortunately the pattern you hear from these situations is that the council interviews are often done to try to incriminate someone.
One area where I believe you have to be careful is if they offer a fixed penalty. I understand (not being an expert, so don't take as gospel) that this can leave you with a criminal record in some circumstances. So research this and understand precisely what they are offering as a settlement, if they do.0 -
Hmm not sure where I've gone wrong...
1: decline the interview and issue a written statement
2: they will try to catch you out
3: they will offer a FPN
Oh yes...
OP do whatever u feel is best.
Or specifically your sister and father.0 -
go and take a friend - preferably a man who will not let them intimidate your sister. Let her sit there quietly and just say she has not dumped anything at all - then ask for their proof. If they have no proof say you will be seeing a solicitor to sue the council for harrassment if they persist in contacting you over this matter. Thank them and leave.0
