If the area is too treacherous for you to wander out and clean up then it is too treacherous for your dog to be out there.
As it is above a shop there may be hygiene issues to consider if it's a shop that sells/serves food. Dog poop getting watered down in the water the roof holds and running down the side of the building.
Personally I would stop letting the dog use the area at all and take the dog on a lead down to the pavement when it needs to go out like thousands of other people around the country have to if the have dogs in flats.0 -

No it doesnt say anything in my tenancy agreement about it although i have cleared most of the stuff that was on there myself for safety do to the weight of everything that was left on the roof when i moved here, but it is for outside garden space, not for repair or maintenance ect, my dog is alot more sure footed than i so when he goes out there he has no problem whatsoever, as for a dogsitter....im a single parent there is no way i can afford sitting services or dog daycare, and hes not left in the garden all day long either as some people seem to assume he is, and again, its not an issue of not being able to pick it up, i do go out there and collect it up, and no personally i dont take a torch out with me when i walk him, i live in a built up town that is well lit i stick to the main roads when walking as the area i live isnt very pleasent if your a lone woman walking the streets at night,0

Blue Moon Fairie - if the roof is so difficult and dangerous to get on - WHY do you let your dog to go there at all? Why not take the dog outside properly?
Or does the dog have access to that roof that you call garden when he is alone/unsupervised?
Is this a "communal garden"? Has anyone else got access to it? Or is it fenced off and only you can access it?
It is not very clear from your description.
If the "roof is flat and holds water" - I do not want to imagine how it STINKS mixed with days worth of dog poo.
Take the dog outside in the morning.
If you are out all day - you need to get a dog walker to take the dog out midday.
Take the dog outside in the evening.
When I say outside - I mean out for a walk and to pee/poo somewhere where you CAN (and will) pick up straight away.

yep that would be best.....except for the fact that i then have to dress a child for outside ect and get down a flight of stairs out of the flat and to the pavement all before my dog has to go.....or do you suggest i leave my child unattended in a house?....seriously i am trying my best,0 -

yes and as in my above post i take him out as soon as i get home.....however first thing in the morning and last thing at night he goes in the garden,
Anyway i think its time to end this post, because its coming across as i am an awful person who mistreats her dog and child and is lazy, none of which is the case, im hard working and i just needed advice on something that i have cried most the day over because the thought of being in trouble or causeing anyone trouble is pretty shocking to me as im not that person,0 -
You want to "end this post" as you are not getting the answers that agree with what you believe.
Sorry but open your eyes to the fact that your attitude DOES bother other people.
You do have to change your approach and ways I am afraid or this can turn up really nasty for you.
What advice did you expect honestly?
Dog should NOT be pooing/peeing on the roof, dog SHOULD be walked for both exercise and toilet. No rocket science to it.
You owe it to your dog to make time for him and you owe it to people living around you to be considerate - leaving dog poo around (for whatever reason) is very inconsiderate.
The roof does not seem to be your own personal enclosed garden so stop using it as a dog toilet and causing nuisance to other people.0 -
I dont have an attitude and i dont expect people to have the same opinion as me, not by a million years would i ever expect that at all, i would love to be able to devote my time to my dog like i always did before hand, however i dont have that now due to a situation change, The roof is a garden i don't know how else to explain it to you i really dont, and my dog is walked twice a day which i also have put in above posts, once by a neighbour and once by me at night,
the only advice i wanted is whether or not really this is justification to have the dog taken away, if that is possible i dont know, i also dont know if i can be fined or well just anything helpfu is what i was looking for,
i hear so many stories about people who have given animals away and theyve ended up as bait or whatever that i really could not bare the thought of that happening to my dog,
I asked on here to generally get advice, the only attitude that i have is that ill do anything to keep my dog and child happy and healthy which is what i am trying my best to do, if i have cause offence to anyone rhen i sincerely apologise wasnt my intention and nor would it ever be, so can we please leave it at this? because i honestly feel awful and guilty enough at this situation as it is,0 -
blue_moon_fairie how about getting yourself a decent torch & when the little one has gone to bed get outside & pick up whatever poo there is?
If it's done every night it's 5 minutes work & problem solved
Like you I walk mine morning & night but one of them won't poo anywhere but in the garden so I do the same as above.Always try to be at least half the person your dog thinks you are!0
