Grant a formal easement.

So another issue arises on my re-mortgage. The solicator has informed me the strip of land between my property and highway I have no formal access over and will need a grant of formal easement.

The land in question is owned by mum. she is of course happy to grant me one. How long of delay will it take for the solciator to resolve this?

  • I can;t tell you the timeframe but do NOT buy without the easement. It will be a nightmare to sell.

    Depends on you and solicitor.

    Depends if mum uses same solicitor or her own.

    Make appointment to see solicitor (1 day to 1 month). Discuss.
    Wait for solicitor to draft (1 day to 1 month).
    Receive draft, review and correct. (1 day to 1 month).
    Send back and await re-draft (1 day to 1 month).
    Receive draft & review & accept. (1 day to 1 month).
    Wait for solicitor to send copy to mum's solicitor (1 day to 1 month).
    Wait for mum's solicitor to review (1 day to 1 month).
    Wait for mum's solicitor to send to mum to review (1 day to 1 month).
    (etc)

    Finally send signed agreed final easement to Land Registry.

    So the answer is between 1 week and 6 months.

    As G_M posts timescales are very dependent on how quickly the solicitors and parties involved work but the fact that the grant is from your Mother should make life a little easier hopefully.

    A formal and legal deed would be required and it would need to be registered against both registered titles - so if your Mother has a mortgage then her lender is likely to also need to be made aware and/or provide their consent - that may add another 1 day to 1 month to G_M's timeframe as a result.

    My neighbours and I did one before I sold my house allowing each property access to a small patch of land belonging to the other (in Scotland, so the process is probably a bit different). It took around 3 months from start to finish to get everything sorted out, and that was with me using the solicitor who was already engaged to sell the house, and the neighbour using the solicitor that the wife works for.
