Parking Eye Issue

Hi all,
Firstly thanks for all the information on this forum, it's been really helpful so far.
I have an issue with a parking eye parking charge that I can't see how to resolve with the current threads.
Situation so far:
- parking charge by post back in 2013 for south mims service ANPR system
- ignored all letters and consequent. (i know this is wrong to ignore now but at the time I didn't see this thread)
- after 9 months i received a letter explaining that the parking charge had been reset to £40 because, they had set the notice to the registered address of the car and not the new address they had from a credit agency (experian). the strange thing is the addresses are the same!!?? the car was always registered at the same correspondence address as the credit information.
- after receiving many more DRP letters (debt recovery plus) I finally found this forum and followed the steps to try and get a popla number. I have received a letter back from them stating that it was too late to appeal and that further action will now be taken. see letter link below.

Where do I go from here. please help any one... I really don't want a CCJ against my name but I really don't want the pay these immoral B*stard bullies..
Do I have a case that they sent a letter (months after the charge date) stating that they had tried to send me the letters previously but it was not their fault that I hadn't received them on the account that the DVLA address was incorrect. (I can prove that the DVLA address has always been the same as my credit address) and the letter from them supports that they did not send me a letter within the 14 days that they need to?? I hope that part makes sense?!

You won't get a CCJ unless you go to court, then lose, then don't pay. You can't just be awarded a CCJ.
I suggest you start with the "Think it's too late to appeal?" part of the NEWBIES thread.

If someone else was the driver, reset the clock by sending them the driver name and address.
Otherwise write and inform them that the debt is denied, you will not pay without a court order, and to save money for both sides you suggest either resolving the issue using POPLA, or waiting until the Beavis appeal has been resolved.
Point out that in any case you will oppose any costs they now incur over £27, which is the cost to them of using POPLA.Dedicated to driving up standards in parking0 -

I am stuck at the point at which they should reject my appeal, and then i go to POLA. i have read every thread an attachment and I can't see what i need to do.
They have simply told me that they are not accepting an appeal, and have ignored my emails about having 35 days to respond to the appeal. (although I understand now that this rule was changed in feb 2014?)
How can a go to POPLA if they won't officially reject my appeal?
do I just write to POPLA anyway??0 -
Like hoohoo said... name the driver to reset the clock.
Have a good hard think about who was driving that day - if it was not you then name the person who was and give PE their details. The 'drover' can then start the whole process from scratch.
Don't dally about, they'll take you to court then your fate will depend on how much you research the case to win. And if you are struggling with the Newbies thread, then a court case does not bode well.0 -
Then have another think about who was driving - it wasn't the keeper was it...think hard. Then follow what the NEWBIES thread says about resetting the clock (obviously that's our phrase to explain it to readers, not a phrase for your letter!).
Don't reply without thinking. Please don't tell us you can't! And I can't take pm's about this, it really is simple. The driver can still appeal so NAME that driver as per the example letter in the Newbies thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
