So I've been here before and has something changed am I in trouble!
I work for the local hospital I pay a monthly fee directly from my wages to total parking solutions. I have a swipe card to gain entry to where I am allowed to park. I am supposed to put my permitt in the window of my car and for only the second time ever in July I forgot! Hence a parking charge notice! I went down the ignore route and received a letter demanding more money ages ago. Today I receive a letter from premier solutions solicitors demanding I pay the now £80 fine or face court proceedings!
What do I do now?? Please help!!

  • You need to give more detail of the exact text. It may be another in the chain of threats. To be a proper Letter Before Claim it must give specifics. It should read along the lines of 'You have 14 days to pay the amount stated or our client WILL commence court proceedings against you.'
    If the word MAY is used then you can relax. There is more to an LBA which better informed people here can help you with but they'll need more details.

    Simple. Copy each line above into Google one at a time and bore yourself senseless with reading all the dozens of times this has been raised before. It's no biggie. What is bad (if in England/Wales) is that you went down the old 2012 ignore route, but no doubt you've sussed before that was wrong because 'ignore' hasn't been the advice for 2 years. You have left the door open to all sorts of silly letters like these, could all have been stamped on at POPLA appeal easily. Never mind. TPS are not litigious.

  • Went down the old ignore route because that's the last time this happened and they left me alone didn't even think to check if the rules were different! So let that be a lesson.

    The letter gives me 14 days to pay. Then there is a paragraph that says,
    " if we do not receive payment of the outstanding sum by the deadline stated above, our client will have no option other than to commence formal civil court proceedings against you and will do so without further reference to you. Such proceedings, if brought, will also include claims for interest, fixed legal costs and court fees, thus increasing the amount payable."

    The deadline they have given me is 11th December only got the letter today!

  • Ok so I've looked at the threads do I respond to the solicitors letter stating that I pay to park where I was parked, I wasn't advised how to dispute the parking notice etc! Or do I chance ignoring it it doesn't actually tell me what law I'm apparently in breech of!

    Either way, TPS are not litigious so ignoring or responding ONCE, is fine. Personally I would ignore it because people always think if they respond that it's all going to change or stop - but the letters will carry on regardless so what's the point of replying, IMHO. You could ask the Solicitors for a Letter Before Claim which is compliant with the rules on pre-Action Conduct, rather than this debt collector version, if you want. But based on other threads why rattle the cage?

  • Well have spent all afternoon writing a letter asking for a compliant lbc not sure if I should post it now?! Although I have to say its a humdinger!!!!

    Send it then, why not, sound good - I like a humdinger of a letter! But after that do not get involved in protracted correspondence, just keep it all in case TPS ever break the habit of a lifetime and try a small claim (very defendable - particularly if a person has kept all the letters and preferably also gets some photos of the signage wording).
