Royal Mail Inappropriate Packaging T's & C's & PAYPAL HELP

Please, please can somebody help me. Long story, which I will try to condense. I recently sold an ipad 2 on facebook for £150. I then packaged it securely (to the best of my knowledge) and sent it special delivery insured (£11). The package was delivered and signed for, but the recipient sent me an ebay message later that eve to inform me that the package had been opened and the ipad was missing!! Apparently his sister had signed for it. I immediately contacted Ebay, who informed me not to issue a refund until I had lodged a claim with the Royal Mail and it had been resolved. The buyer promptly logged a claim with paypal, who refunded his money without asking for any evidence from me. Royal Mail also has now turned down my claim for compensation due to 'innappropriate packaging' and as the buyer will not return the packaging (he's had his refund!), they can only go from a photo they have, which they say puts them fully within their rights to reject my claim So here are my questions:
1) How could paypal refund the buyers money with no evidence he had not taken that ipad himself?? The package was signed for at that address!
2)I packaged the parcel to the best of my knowledge, trying to follow the RM guidelines. They are hiding behind their T's & C's, saying that the onus is on the seller to ensure the packaging is correct in line with their T's & C's 'on the internet'. What if I have no access to the internet?? But this is also not clearly stated at the point of sale, or verbally given by the counter staff. How is this legal or fair? Given that the charge was taken by royal mail at this time it was tacitly implied by royal mail that the goods must be acceptable for this transaction as no statement was made to the contrary. i.e. Why did the post office personnel not state clearly that “ this will not be insured as the parcel you have given me is not viable as it is inappropriately packaged”. Had this been the case the parcel would not have been sent.

I'm so tired of the little man being trodden all over due to unclear T's & C's etc.

Please can somebody advise me :(

    How was it packaged by you ? Contact paypal by telephone (there will be a number for them on the eBay board on this forum) and ask why it was closed without any contact from you.

    Comments like "I recently sold an ipad 2 on facebook" and "What if I have no access to the internet??" are mutually incompatible, so trying to find loopholes there won't be of any benefit.
  • Hi, I have contacted paypal, and all they stated was that they had handled it in accordance with their process. They also would not divulge what type or which evidence the buyer had provided to them. I then posted on their facebook wall, and am now in contact with one of their customer service representatives in Luxembourg, who has informed me that the handling of my case was irregular. However, this still leaves me without any packaging or any way to prove that it was packaged correctly. It was packaged in a rigid cardboard envelope, within its soft padded case, with additional cardboard and padding added. I then added a thick layer of sellotape to the entire parcel. I packed the charger in a separate envelope.
    Apologies re the internet access confusion, I was stating that this makes it difficult for those posting things who might not have access to the internet - ie, their guidelines and t's and c's are hard to access.

  • Have you tracked the iPad or reported it stolen so it gets blocked? That would be the first thing id do.
