Can I issue a chargeback?

I'm having problems having purchased a usb flash drive online (you may have seen the thread over here...)

The product is faulty, the company has only replied to one email, which asked what type of files I was transfering...

PayPal isn't interested as the product was delivered, so can I issue a chargeback (I purchased on switch through PayPal).

    Contact your card provider and ask them to dispute the transaction as faulty goods. Provide your card issuer all the information surrounding the transaction. Your card issuer will be able to confirm if you have valid claim.

    Make sure you phone quickly tho, as banks adhere to strict time frames under Visa/MasterCard rules and regs.

    I'll ring the bank tomorrow, just wanted to know my rights before giving them a call - Will they just take the same line as PayPal?

    I know if I had purchased by credit card I would have more protection, but as the product was under £100 I think this wouldn't apply?

    the only query/concern i would have if is that the monies will initially be taken from Paypal; whom only acted as a funds transfer provider to the company in question - however, im also assured that Banks must deal with this type of issue/concern from customers on a daily basis. They are definately the people to talk to.

    Be truthful in the advice you give the Bank; and as said, provide all information should they request it.

    I would doubt you will have much success, as you purchased via Switch/Maestro, as this gives no statutory purchase protection, and the only time that banks are likely to pay attention is in the case of fraudulent transactions.
    Given that the transaction was also via Paypal I would imagine that your bank will refer you back to either Paypal or the manufacturer

    Except in a few particular instances debit/switch cards do not give you any protection against non receipt or faulty goods. On the ebay forum we usually recommend backing paypal payments by Credit card as you do then get protection, at least against non receipt.

    It's also worth noting that PayPal recently relocated to Luxembourg for the purposes of this type of transaction.


    In the event that a dispute arises against a PayPal transaction, the card issuer is absolved of responsibility under the Consumer Credit Act as the transaction is deemed to be of an overseas nature.

    Interesting, showing as PayPal SAN JOSE on my statement

    Will still make the call tomorrow - got to be worth a shot

    A lesson learnt I guess :confused:

    I know that Credit Card companies liability for overseas transactions was initially wiped following a court case, last thing I heard this was overturned in the court of appeal?
  • Today noticed £40.50 out of my account supposedly for a PayPal transaction (which I have no knowledge of). Have asked my bank (HSBC) to dispute this transaction. Will let you know what transpires.
