Am I entitled to a refund?

Hello all,
I bought my girlfriend some GHD Hair Straighteners last year for XMAS. They broke about 3 weeks ago, 10 months into a 12 month warranty. After being told when I returned them 3 weeks ago that there would be a 2 week turn around time and constantly lied to on the phone I have now been informed that they are going to instead of fix the straighteners send me a new set.
The only problem is they Haven't any in stock but on the Official GHD website they are in stock and I can order them.
Please were do I stand with this? Am i entitled to a refund or not? Me ads my girlfriend are travelling for a 6 weeks soon and she really needs them asap.

You can ask for a refund, however they dont have an obligation to provide one. If they do, they can also reduce the refund to take into account the use she has had of the straighteners.
The law states they have to remedy the situation in a reasonable time. Whats reasonable is a case for a judge to decide, however waiting a few weeks for stock to arrive I personally think would be seen as reasonable.0 -

Their hair straighteners warranty is 24 months, had to make a claim on the Mrs after about 22 months and have to say that they were very helpful and polite when I dealt with them.
Your statutory rights all exist with the company you bought them from rather than the manufacturer. If you didnt buy it from GHD directly then you simply can read the terms of their warranty on what you are and arent entitled to.
Your rights with the retailer would be modest, the retailer has the choice as to if they repair, replace or refund and you can only express a preference. The law also gives them a "reasonable" timescale for dealing with the matters without it being set in stone. A rule of thumb is 28 days but it is variable depending on the exact problem etc. Even if the retailer did refund they are entitled to only give a partial refund to reflect the use received prior to them breaking.
Id ask them re the difference between the website and them saying they dont have any. In many cases manufacturers subcontract things like their ecommerce or repairs out to other organisations and so despite everything being branded GHD its not necessarily the same two companies0
