How the practice of charging English students more than other EU students hasn't hit a legal barrier; i don't know. I'm sure someones done due diligence though

Nationality doesn't come into it. Legally, there's no such thing as Scottish or English nationality - we're all UK nationals.Do you know anyone who's bereaved? As posted above, the discrimination is on the basis of residency rather than nationality, and so is permitted.
It should also be noted that students in Scotland do not have access to the same system of maintenance loans as those in other parts of the UK, and so struggle more while actually studying.0 -
If discrimination based on residency is fine with the EU. Would that not be the answer to Camerons problems with benefits for migrant workers. Just set a 15 year residency condition and the problem is solved.

Wasn't there a court case through the ECHR recently that decided just that? I'm sure there was.
When I moved to Aus, I couldn't claim benefits for 2 years. If a skilled migrant moved here then they can't even have medical treatment or get the kids educated on the public shilling.

Not without getting firebombed.There was a test case last year which was thrown out because the policy is based on residency and not nationality. Student's name was Liam O'Connor should you want to find out more.
It looks like it wasn't a "test case". No judicial decision was made. The complainant failed to get legal aid to fund the case, didn't have the money to fund the case, and so gave up.

They seem a bit more fussed in NI. The Scots apparently have a 'problem' with NI students getting themselves an Irish passport and then putting down their auntie's address in Galway as their home.0 -
Also interesting to note that English universities are out of line with the rest of the EU on this. Germany has scrapped tuition fees, French and Spanish fees are relatively low and much of Scandinavia is free too.0

Pretty much spot on. Third highest university fees in the world. Thank goodness the degrees are so short, or it would be unaffordable.
In other news, Scotland and other EU nations who see education as a right rathert than a good charge little or no fees to each other as their students attend each others universities. Here in England we'd be more than welcome to join this setup if we didn't charge everyone these huge sums.
Or we could freeload on the Scots by pretending they'd have to be bigots to refuse us, but surely nobody was suggesting that we do that.

If Scotland left the UK and remained within the EU (let's not get into that for another 20 years) then it could no longer charge UK residents only for going to Scottish Unis. It would have to charge all EU citizens or none.
Actually, it would have to treat all EU citizens in the same way it would treat Scottish citizens.0
