Question about an Amazon return

Hi all

Cut to the chase, I purchased something for my sons birthday (a remote control dinosaur) in September 2014. It cost around £40.

When it arrived, the box was a bit battered but the toy itself seemed fine.

It developed a fault after a few weeks but for various reasons I never got round to contacting the seller but recently my son has been asking about it.

The seller is an third party seller on Amazon.

I contacted them last night and they said sorry it developed a fault but its outside their 30 days returns policy

I contacted Amazon directly and they said i should contact Fisher Price directly as it should be covered by a 12 month guarantee.

I think they are fobbing me off but could anyone give me a bit of advice on this? I cant see Fisher Price saying "Oh sorry, please return it"

Could be wrong of course!!

    Its the third parties responsibility to resolve your issue for you, not the manufacturer.

    As its under 6 months they have to prove the fault isn't inherent under SOGA.

    Go back to the third party again and advise them they need to find a resolution for you.

    Your statutory rights are against the seller and they should provide a remedy under the SOGA if the item is faulty. Having said that it will probably be easier to contact the manufacturer with regards the warranty.
