payment didn't go through in shop

Hi,

I recently went to a beauty shop to have treatment, offered payment with a debit card. The shop didn't have any paper in the machine so didn't get a receipt. I was not all that bothered.
A few days later, the shop contacted me to let me know that the payment din't go through as their machine was not working on the day and they had to recall all their clients to collect payment. I would like to know whether I am still liable for the payment as I offered payment for the service received but it was the shop's fault for not having paper and machine working correctly. What kind of legal action can they take? (it was for £180).

    They could make a claim against you to recover the money, and associated costs I would imagine.

    You used their service for which you need to pay.

    Check with your bank that there are definitely no pending payments.
    They can take it to court if they wish or they might write it off but morally you should pay them the money.
    Unless their mistake has caused you some hardship just send them a cheque.

    If this costs you extra (e.g. if you have to pay parking to go back and pay) then I think that that is perfectly acceptable to be deducted from the bill.

    But you agreed to pay.
    You haven't yet paid.
    You need to pay.

    I take it you were happy with the service otherwise you would have not attempted to pay. Do the honourable thing and pay up.

    Check with your bank if the card was authorized.....you will have to pay if there was no charge involved for the service offered.

  • Presumably this is a small business with people working hard for their money... if it was one of the big chain supermarkets like Tesco then the devil on my shoulder might tell you to make them work for it... either way it is still legally due and you should pay it.

    Can't believe you (or anyone else) would try and get out of paying it.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
