Still waiting for refit costs

Hi all hoping for some help here,

I bought a shower which I had to pay to be fitted (it was in various parts).

One of the parts broke when it was being fitted. The supplier sent out a new part but I had to pay again for the plumber to come out and fit it.

The same part broke again a few months later and I went through the same process but this time I wanted refit costs as it is clearly a faulty part.

The supplier has now had an invoice from the plumber for 10 weeks but are not reimbursing me, even though they appear to have agreed they would. I am getting various excuses including that they are waiting for confirmation from both the manufacturer and the distributor to agree costs.

I didn't believe them so rang both other parties and found out they both agreed the cost over 6 weeks ago. The supplier is therefore lying to me about what is going on.

Is there anything I can do to get my money back?

    Did you pay by credit card and was the shower priced over £100? If so, contact your card company about a section 75 claim - section 75 of the consumer credit act makes your card company jointly and severally liable for the performance of the contract.

    Yes you can.

    But don't take my word for it, ring your credit provider.

    Basically you have the same rights with your card company as you do the retailer/supplier. Which is exceptionally handy where the retailer goes bust or point blank refuses to help.

    These are costs you would not have incurred had the breach of contract not happened, therefore they (retailer and card company) are liable.

    ETA: Also has the benefit that if your card company refuse your claim, you can refer it to the financial ombudsman (can still later go to small claims court if necessary but its two added levels of protection).
