Russell Hobbs I Love Home – photo competition

I. General
•You may only participate in this competition if you observe and accept these conditions of participation.
•This competition is organized by Russell Hobbs in the UK.
•The competition starts at 12.00 GMT on 29.10.2014 and finishes at 12.00 GMT on 30.021.2015
•Russell Hobbs reserves the right to postpone or terminate the competition at any time without prior notice and without giving reasons. In particular, Russell Hobbs may exercise this option if the proper running of the competition cannot be continued on technical grounds (e.g. viruses in the computer system, hardware and/or software manipulation or errors) or on legal grounds. If termination of this kind is caused by the behavior of a participant, Russell Hobbs reserves the right to claim damages against that person.
•In case of a dispute, Russell Hobbs' decision shall be final.

Prerequisites for participation
•Participation is open to any natural person of full legal capacity, aged 18 years or and above, in their own name, residing in the UK.
•Minors, employees of Spectrum Brands Ltd and its associated companies and their relatives are excluded from participation. [Only one entry and one photo upload per participant is allowed per week .] Participation in the competition by competition clubs or agencies is not allowed.
•In order to participate, entrants must register at http://uk.russellhobbs.com/ilovehome/ providing their surname, forename, country, age and a valid e-mail address, and they must upload a photo telling us what they love within the Promotion Period. Only photos which fit to the competition subject “Tell us what you love about home” will be accepted.
•The content of all photos submitted within the Promotion Period will be checked by Russell Hobbs before they are published in the gallery on http://uk.russellhobbs.com/user_images.html?mechanicID=1 Russell Hobbs reserves the right to delete photos with unsuitable content, e.g. racist, vulgar, pornographic or advertising content or inciting violence, as well as photos which violate applicable law or third party rights, e.g. intellectual property rights (brands, logos, trademarks, etc.). Participants who have uploaded such contents or photos which include those contents will be excluded from the competition.
•Russell Hobbs also reserves the right to ban participants from the competition and to delete their photo from the gallery in case they violate these terms, enter untrue personal data or try to influence this competition by technical manipulation. In case of a ban the prizes can be withdrawn and reclaimed retroactively.
•After registration and approval by Russell Hobbs the participant will receive an e-mail including a link to confirm his/her entry in the competition.
•Participation is only possible within the period specified in Section 1. In the unlikely event of a dispute, Sponsor’s decision shall be final.

Prizes
•The first prize is a Russell Hobbs Buckingham Kettle, photo entries received from 07.11.14 until 11.11.14 will be entered to win this prize
•The second prize is a Russell Hobbs Illumina Toaster, photo entries received from 12.11.14 to 27.11.14 will be entered to win this prize
•The third prize is an Aura Hand Stand Mixer, photo entries received from 28.11.14 to 05.12.14 will be entered to win this prize
•The winner(s) will be determined by a jury consisting of Russell Hobbs employees .
•Winner(s) will be notified by e-mail and published on the competition website or on the corresponding country site or Facebook fanpage within two weeks after the end of the Promotion Period.
•In this e-mail notification, the winner(s) will be asked to state their full address so that the prize can be delivered.
•If a winner cannot be contacted, or fails to respond within 4 weeks after the e-mail notification has been sent, or a prize is returned as undeliverable, the winner forfeits the prize. Russell Hobbs will award the applicable prize to an alternate winner.
•Prizes are as stated and not transferable. No cash or other alternatives available.

Usage rights on submitted photos
•By participating the participant acknowledges and agrees that the submitted photo may be used by the Russell Hobbs or one of its affiliated companies for marketing purposes on the international and national websites of Russell Hobbs and its affiliated companies, on international and national online marketing communications, e.g. Facebook, Twitter, etc. and as part of newsletters and internal and third-party product presentations.
•The participant agrees to transfer to Russell Hobbs free of charge a temporally and geographically unrestricted, exclusive, irrevocable right to use the submitted photo allowing Russell Hobbs to use, duplicate, distribute and publish and generally make accessible the photo for the above mentioned purposes.
•Furthermore the participant agrees that Russell Hobbs may edit or modify the photo, such as for example changing the format, size, or cutting.
•By uploading a photo the participant acknowledges and agrees that his/her photo is connected to so-called “share buttons” of third party social media platforms Facebook, Twitter and Instagram. These buttons enable third persons to distribute and publish the photos which were uploaded to the competition website within Facebook, Twitter and Instagram through the third person’s private account. In addition, the photo can also be commented by third parties within these social media platforms. Russell Hobbs does not control the use of these share buttons and cannot access them. All content once published on the social platforms is covered by the respective terms and conditions of the social platform.

Liability
•No claims for damages – insofar as permitted by law – may be made against Russell Hobbs in connection with the competition on any grounds whatsoever, unless Sponsor is in breach of its legal obligations as a result of malicious intent or gross negligence. Furthermore, the exclusion of liability does not apply in the case of breaches of the product liability law or in the case of injuries to life, limb or health.
•Russell Hobbs is not liable for damages arising from lack of availability of the competition website due to technical faults and instances of force majeure beyond its control, or due to attacks from third parties on the competition website. Russell Hobbs will make every effort to ensure the availability and reliability of the competition website. Russell Hobbs also does not make any guarantee that the competition website will function properly on any individual participant's computer.
•The participant guarantees that he is the author of the submitted photo and that no third-party rights are violated. Furthermore the participant guarantees that he/she has all copyrights and all other intellectual property rights to upload the photo and to grant to Russell Hobbs the rights of use as described in Section IV.
•In case the photo shows other persons than the participant, the participant guarantees that he has the necessary consent of the concerned persons or in case of minors that he has the consent of the parents/legal guardians for uploading the photos and that he is authorized to grant to the Sponsor the rights of use as described in Section IV.
•The participant indemnifies Russell Hobbs in full against all third-party claims based on the use of the photos submitted, including the reasonable costs of legal defence and/or prosecution.
•Each winner is responsible for any taxes payable due to the competition as required by local law and indemnifies Russell Hobbs in full against any third party claims. VI. Data Protection
•Russell Hobbs guarantees compliance with the relevant legal provisions for data protection. Particular reference is made in this context to the Russell Hobbs General Data Protection Declaration.
•Russell Hobbs will collect, process and use the personal data of participants exclusively for the purpose of the competition. The participant hereby expressly declares his/her consent to the collection, processing and use of the personal data given for the aforementioned purposes.
•Russell Hobbs is entitled to pass personal data to an external agency which is taking care of the execution of the competition and to third parties to the extent that this is necessary for carrying out the competition or transferring the prize.
•The participant agrees, should he/she win, to the publication of his/her surname, forename and country of residence on the Russell Hobbs websites, online marketing communications and in a press release. A photo of the winner may also be published in the press release.
•If a participant has signed in for the Russell Hobbs newsletter the participant explicitly agrees that Sponsor uses the personal data for sending out the email newsletter containing current offers, news and product information relating to Russell Hobbs products.
•The participant may at any time withdraw consent to the storage of his/her personal data as well as to receiving the newsletter.

Severability Clause

Should any individual provision(s) of these terms of participation be invalid, or should an omission be found, this shall not affect the validity of the remaining provisions. The invalid or missing provision should be replaced by a provision that most closely approximates the purpose of the contract and the legal regulations.
