Devere Parking Noice - Appeal rejected

Got a parking charge notice from Devere Parking Services Ltd at Castlepoint in Bournemouth.


I appealed with the info' from here regarding unfair charge etc.


Appeal rejected and they now say pay up or lodge a further appeal with IPC.


Any pointers? I live nowhere near so their friendly judge won't help.

    The Devere 'cases' that appear on the forums almost exclusively involve residents of the Bournemouth area whose local court is Bournemouth. So this is one new situation.


    This would also appear to be the first Devere 'case' that has appeared on the forums since he decamped from the BPA to the IPC, in August I think it was.


    Why would he have moved from the BPA to IPC ? For a cheaper appeals process and greater chance of rejection of drivers appeals, so potentially increasing revenue without recourse to issuing court papers.


    As Devere is one of the most litigious PPC's it won't worry him too much if you fail to pay on a rejected IPC appeal. IPC are a private company set up for the benefit of PPC's who were fed up with the costs and number of successful appeals at POPLA


    I would personally look at making a small investment for the services of http://www.bmpa.eu/ I have no connection with them but I think you need good, off forum advice and you need to let Devere know you mean business at the IPC appeal stage. This should help dissuade Devere from investing a further £25 or so in a court claim via Northampton when the appeal is rejected.


    Remember that this isn't a corporate entity going through a paperwork excercise, it's one bloke deciding how much of his time, effort and cost he wants to risk. The further you live from Bournemouth, the better.

    Show us the signs please (photos of how it is now, readable wording). I saw Castlepoint signage last year before they hopped to the IPC, and at the time it was worded about 'breach' of terms & conditions, not written as the IPC want them to (consideration/contractual fee). It was an easy one to win at POPLA but not so easy at IAS.

    Was this a disabled bay one and was the driver/passenger disabled? If not, what was the scenario?

    Indeed Devere have cancelled before on a disabled one

    - the amazing reduced offer allegedly going to a charity I believe?

    IIRC this was then revoked - however a suitable appeal did make Devere cancel in the end. :)

    I would suggest that the OP emails this information to the BMPA - as our lovely Devere friends will no doubt be reading the forum - and this can be dealt with out of the public gaze.
