More marketing calls. AARRGGHH

Options
So we are TPS registered and still get calls from the hearing clinic! But they are not sales calls so TPS does not apply, they say they are marketing calls!

  • I used to receive calls from them but suspect my number has been removed.
It's amazing how many times they can be made to repeat, in ever increasing volume, what is being said because "I'm sorry would you repeat that, I have a hearing problem."
Mostly it takes quite a while until the light bulb moment and they hang up!

Actually marketing calls are the same as a sale call. If you meant a survey call then you will be right, as they are not covered by TPS.
However if you want to "p*ss them off", I suggest you send them a Subject Access Request and ask them where they got your phone number from.

Not really a good idea as the company are allowed to charge a fee of up to £10.00 for answering a SAR.

But you don't need to enclose the fee, do you?

    Knightstyle,

You need to change YOUR attitude to cold callers. Instead of getting wound up, take a second to breathe and think. Change your attitude from anger to having fun (if you're not in a rush).

Be polite and talk gibberish, ask the caller something random, football, the weather, anything. The longer we all collectively keep them on a call the fewer calls they will be able to make. Think of it as our civic duty to each other.

Most of the time it's pointless asking them to remove your number from their database. Even "decent" companies will make you make several requests before they do so. What they preach in public they'll change in the real world of the call centre.

And if they really persist the best questions to ask are:

    (1) What are you wearing?

    (2) What's you favourite sexual position?

Thanks for the info, but I'm well aware of the potential charge. However, phoning a TPS registered phone number is a breach of PECR2003 for which you can claim damages, so the caller may not be so willing to ask for the £10.

They also may not be willing to provide the information requested.

But I do agree, it may tie up their resources for a few minutes.

Sure, one can claim damages. What losses are we talking about here?

Since buying a call blocker off ebay (£25 the little white one sold by several sellers) my calls have reduced. Checked the log and nothing at all for 30 days.

No internation which were coming in at several per day, None of the Manchester number PPI claims companies.

NOTHING.... Peace at last eh.. If one does sneak through it only takes one press of a button to block them.

They are legally required to provide the information within 40 days, failure to do so is a breach of the 1998 Data Protection Act. If they refuse I normally write to the Information Commissioners Office; and that normally gets an answer.

As for claiming losses it depends how much time you spend on the matter, but I normally warn the company when I send the SAR that I may seek compensation for my time and costs.

I use to get annoyed with cold callers didn't vent this so much at the caller just wound me up. But life is too short to have your day spoilt. I just use a call blocker now. Cold callers dont get through despite continuing to try
