  • Ok thanks, for the convenience factor I'll opt for email. would you say its worth using my girlfriends email address or does it not matter?

    The thing about email is that it's deniable, you cannot prove that you sent it or they received it. But no, it will not matter what email address you send it from.

    Hello again, they rejected my appeal, and the letter is below. Also on the letter they have their logo at the top, the address tel. no. and website at the bottom, along with their company reg no. 08047971:

    Issue Reason: Entering A Buses Only interchange
    Location: xxxxxxxxxxx

    Dear xxxxx,

    Thank you for your appeal letter regarding the issue of the above parking charge notice.

    After reviewing the information provided within your appeal letter and the photographic evidence that was taken in support of the issued PCN,and although we have taken into consideration the mitigation that you have provided we have decided that the parking charge was correctly issued for failing to comply with the parking conditions at xxxxxxxxxxx. There are in excess of 40 signs installed from the entrance and in and around the car park clearly displaying the parking conditions that are in place.

    With regard to your statement on pre estimate of loss. Not entering a no access zone and not parking in a no access zone is a condition clearly set out in notices within that area that each driver agrees to on entry at this location. Our charges for a driver failing to adhear to these conditions are within the recomended guidlines advised by the British Parking Assosiation whome we are an approved contracter.

    You now have a number of options;

    1.Pay the Parking Charge Notice at the prevailing price of £60.00 within 14 days. Please note that after this time the Parking Charge Notice will rise to £100.00
    2. Make an appeal to POPLA – The Independent Appeals Service at popla.org.uk. Please be advised that if you opt for independent arbitration of your case, the Parking Charge Notice will increase to £100.00 should the case be in our favour. Please quote verification number xxxxxxx
    If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed with Court action against you.

    Did you copy and paste their letter, or have you re-typed it?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    2 A trouble maker could use it to enter a BS appeal on the POPLA website

    I'm sure there is more :)

    Have you already complained to the BPA/DVLA about them using info they had no right to access?
