Does backing up data to google servers -then restoring the OS mean that the latest version of Android is installed !?At present - my Samsung note 1 is on 4.0.4 and I have been unable to update this due to errors and wondered what version would install if I did a data back up and rebuild via this method....

It will probably be the version you have now if you reset it. The one that is supported by Samsung for your device.
If you wanted to get anything later, you would have root it and do all sorts to it first.0 -
